This draft Circular provides for the financial management of the implementation of the Intellectual Property Development Program up to 2030 specified in Decision No. 2205 / QD-TTg dated December 24, 2020 of the Prime Minister (Programme).

Funding for the implementation of the Program is guaranteed from the following sources: The State budget includes the central budget for science and technology spending to support projects, joint activities and tasks under the Program directly managed by the Central Government; Sources of expenditure for science and technology under the local budget and other funding sources.

The draft clearly states the content and level of spending for the task of promoting registration of intellectual property protection in the nation and foreign countries. Accordingly, supporting funding for registration of protection for inventions, industrial designs and trademarks; registration for protection and recognition of new plant varieties by public non-business units that are subject to state budget support according to regulations.

The level of support for domestic protection registration is as follows: For an invention protection registration application, the maximum of  30 million VND / application; for an application for registration of protection of industrial designs and trademarks of organizations and individuals, a maximum of  15 million VND/ application; for a new plant variety protection registration application, a maximum of 30 million VND/ application is required. Support level for registration for protection abroad: Maximum of 60 million VND / application.

This level of funding is the maximum level of support from the state budget; in the event of additional expenses (if any), the program participants will ensure themselves.

Also according to Decision No. 2205 / QD-TTg, the Ministry of Science and Technology is the lead agency, administering, managing and implementing general and regular activities of the Program. The Program's standing agency is the National Office of Intellectual Property of Vietnam under the Ministry of Science and Technology which is responsible for organizing the department to act as the focal point for the implementation of the Program on the basis of balancing and adjusting the existing human resources of the National Office of Intellectual Property of Vietnam.
